much advice needed please..

Okay so here's the deal. earlier today i got a speeding ticket, with the officer claiming I was going 70 in a 55 mph zone... The thing is last fall I got my first speeding ticket ever, and at the time of that one had to pay a huge fine, do the whole driving school thing, take a test, and go through a lot of hassle just to get everything cleared up, just because of a speeding ticket. Well since then i haven't gone over 10 mph over any speed limit because i realized it just wasn't worth it..

well i'm taking summer classes at a university that's about 45 minutes away from where i live, and it's 4 days a week, so i've been driving a lot back and forth . and the speed limit on the highway like is 55 mph.. I've driven down those roads so many times now and i know i had the cruise control on at 62 or 63.. i never set it anything higher than that, and i know for a fact that i had the cruise control on at the time i was driving and was pulled over.

well the officer turned out to be a real dick and at first didn't even tell me how fast i was going or why he pulled me over.. he was even going the opposite way and went out of his effort to turn around and come after me. anyway he told me.. after i asked .. that i was going 70.. and then he went back to his car and printed out the citation and all of that. And when he came back over to my car.. here's pretty much exactly what i said ...

"officer i mean no disrespect, but i was wondering if there is any chance out all that something might have been misread, because i know i had my cruise control on and was going no more than 65, let alone 70."

and it was like no one had ever questioned him about anything before.. like he's always right.. and he said like 2 or 3 times that "everyday i calibrate my machine to check and make sure.. " and i couldn't even get a word in after that because he kept on saying the same thing and sounded more and more pissed each time.. and then finally i just said "fine" .. and then he said in this really, like obnoxious way "if you want to go to court and fight it be my guest... have a nice day" and just stomped off.. and i know the "have a nice day" looks nice typed out, but the way he said it was the exact opposite..

anyway needless to say i'm pretty pissed off right now.. because i know i wasn't going over 65 .. and i have a $160 fine now.. and probably points added onto my liscense.. and my insurance will probably end up going up as well.. which is why i really don't want to tell my parents right now.. i mean they're understanding.. but i have a feeling i'm going to be getting the same speeches and i know what i did , and i know i was going 7 or 8 over, but not 15 .. and at this point i'm really tempted to take it to court on the date and try and fight it, and i was just wondering if anyone has done that before?? or how it works out when you do that?? how do they show they have evidence on you and how exactly can i fight it? any help or advice would be greatly appreciated..

Shit, thats big. You should ask some athorized to look at his radar gun and shit. Wouldn't the movement of his car increase the reading radar? Were you around anyone else that was going fast? Your same car color? Type? Was he in the lane closest to you on the other side of the road? Were their any cars blocking you and the cop that might have been going 70 around you? I'm good at getting out of trouble with the law by finding loppholes. I have 5 saves total :cool:

So you said you've gotten out of 5?? What do you have to do or say when you're at court? But he was on the opposite side of the road, farthest away from me.. And it was pretty much the middle of the day, so the roads weren't bad at all.. i mean there were other people, but it was pretty clear that he signaled me out and not from someone else.. not that i know of.. I'm not sure i mean if i had been going 70.. and i knew it.. i would just own up and pay the fine.. but i honestly believe i was going 62 or 63.. Anyway my car is a 99 white grand am SE... i dont know.. i really want to try and fight it, but i mean if i have no evidence or anything.. than it's just my word against his.. and that probably wouldn't turn in my favor.. what all do you do if you take it to court??

You said you set it at 63? That still 8 over the limit and any cop can pull you over for that, I wouldn't argue the case in court, it's a sure loss. If your arguments that you were set at 63, the judge will still say your'e speeding. I always drive at a max 5 above, cops usually always give that leniency, once you go above, that you cant argue anything really.

Correction: I said i've gotten 5 saves. 3 for my Uncle and 1 for Mom and 1 for Dad. I didn't go to court with them but they got out of it. All my uncles tickets and my dads were called off because the radar guns were fucked up big time. (They ran a test and it read 25mph at 70mph) My mom was driving the same color and type of car as a speeder. They got the plate number and realized they made a mistake.
You need to be sure about your details before you go to court. When you do get then straight, then if he was on the oppisite sides, were there any cars by him? Around him? Could the shot have hit a car driving by him as he was driving by? How many cars were between you and him? What color were the cars around you/him. Were any of them white? This all needs to be clear for a good chance at winning. :cool:

never mess with the police or take it to court, specially when you were still speeding, although they were a bit wrong, you'll lose the case, also you'll have to pay everyone's court expenses if you lose, so i wouldn't be too hasty with this. My brother got a fine for smoking underage (he was a month away from being 18), it was about 18 dollars, fine, that's not much, but they didn't send the fine and we didn't even know it. Next thing, 2 months later they sued us for a fine that's already 80 dollars.

I mean, why didn't they let it get to 800 dollars then? That would be more fun. Bunch of twats.

Yeah i see your point.. But i'm not really sure how this whole system works, but wouldn't a fine at 63 be better than one at 70? It's not so much that i don't mind paying the fine, but what I'm worried about is the points and stuff getting added to the liscense, and the whole insurance thing.. because they have me going 15 over, when i was going less than 10.. but i dont know...

when i got my first ticket back in the fall.. and that was like my first ticket after 2 and a half years of driving, i rented that DVD from blockbuster about ky state driving, and took the test, and therefore i didn't have any points added to my liscense... but the thing is it's been less than 12 months since that one and the one now.. and i can't do the dvd thing.. but do you think they would let me go to an actual school.. or is that still considered the same thing??

and also, how could i get them to check the radar gun? i know it's a long shot there.. but still...

really? cool. i was sure you got it from that book. anyways, you should check it out. everyone should have at least 3 Uncle John's Bathrrom Readers. you have to read them on the toilet. :wink:
